Local collective agreement on standby

1. Initial provisions

1.1. Scope

It is noted that this agreement has the same scope as the central agreements Villkorsavtal/Villkorsavtal-T.

The employer can order standby if it is necessary for the nature of the business that an employee is at the employer's disposal to perform work when needed.

1.2. Definition of standby (Swedish: beredskap)

Standby refers to the time when the employee is at the employer's disposal during work-free time/duty-free time. The employee is obliged to be available by telephone to perform work via the telephone/computer and by presenting themselves at the workplace. The issues should be solved remotely at first hand. If there is a need for the employee to present themselves at the workplace, this must be done within 60 minutes. This applies unless the employer decides that the employee can present themselves at the workplace a later time.

1.3. Period of validity

The agreement is valid from October 1st, 2015 until further notice with a three months notice period.

2. Conditions for standby

2.1. Compensation for standby

Compensation for standby is paid for the time the employee is on standby. The size of the compensation is stated in this local collective agreement and is based on three different levels.

Compensation is paid per hour for simple standby unless otherwise stated below.

Compensation is paid per hour for qualified standby for standby happening:

  • Between Friday 19.00 o’clock and Monday 07.00 o’clock
  • Between 07.00 o’clock and 19.00 o’clock if the standby falls on a bridge day according to the local collective agreement on working hours for technical and administrative employments
  • Between 19.00 o’clock on the day before Epiphany, May 1st, Ascension Day or National Day of Sweden and at 07.00 o’clock on the following weekday.
  • Otherwise, between 19.00 o’clock and 06.00

Compensation is paid per hour for increased qualified standby for standby happening:

  • Between 19.00 o’clock on Maundy Thursday and 07.00 o’clock on the day after Easter Monday (major holidays)
  • Between 19.00 o’clock on the day before Midsummer Eve, Christmas Eve or New Year's Eve and at 07.00 o’clock on weekdays closest to the holidays (major holidays)

Compensation for simple standby is SEK 25.

Compensation for qualified standby is SEK 50.

Compensation for increased qualified standby is SEK 80.

The compensation includes vacation pay.

Compensation for standby is not paid for standby during regular working hours or when working overtime.

Employees with regulated working hours without the right to overtime compensation and workers with non-regulated working hours receive compensation for standby even for worked time during the time for standby. Thus, compensation for overtime is not paid.

2.2. Compensation for work during standby

For work that can be done by telephone or otherwise without presenting themselves at the workplace is counted as half an hour's working time. Multiple tasks within the same half hour do not mean that the hours worked are counted as more than half an hour. For working more time than half an hour, the actual time worked is compensated.

For work that requires an employee to present themselves at the workplace, the working hours are counted from the commencement of the journey to the arrival at the workplace, the time of executing the work and the return journey. Two hours (at least) are counted as working hours. For working more time than two hours, the actual time worked is compensated.

The time needed for work beyond the specified time limits, whether work is done remotely or by the employee presenting themselves at the workplace, is rounded up to the nearest half hour.

For work during standby, overtime compensation is paid.

Note: Villkorsavtal/Villkorsavtal-T states that the employer can require a part-time retired employee to do overtime work for a maximum of 25 hours per calendar year.

2.3. Organization of standby

Standby can be applied to affected workers, for occasional occasions or ongoing according to schedule.

Before the employer establishes a schedule or duty for standby, the relevant employees shall be consulted.

Organization of standby shall normally be notified to affected workers two months but no later than four weeks before the standby is to be completed. At the same time, the local employee organizations must receive written information about the organization.

Notice of standby should, however, be given no later than two days in advance if it is caused by a particular circumstance that could not be planned in detail by the employer or even shorter time in advance if it is caused by a particular circumstance that could not be foreseen by the employer.

An employee should not be on standby for more than a week in a row, no more often than every four weekends and no more than seven days/24 hours per four-week period.

In the event that the standby is interrupted by work, the regulation of 24 hours of rest in the Working Hours Act and the Villkorsavtal/Villkorsavtal-T must be taken into account. However, the employee must be deemed to have received adequate protection in case the standby is not interrupted by work. Compensatory rest for any interrupted 24 hours of rest should be placed within one week of completed standby. However, in the event that the work in standby is completed after midnight, a rest period of seven hours shall follow.

Note: According to Section 14 of the Working Hours Act (1982:673), an employee is entitled to a minimum of 36 hours of uninterrupted rest per every seven day period. The weekly rest period does not include time for standby.

2.4. Journey to and from work

Traveling for the purpose of being present at the workplace is reimbursed if the employee has had extra costs for traveling to and from the workplace. Compensation is paid when receipt for public transportation has been handed in or when using one's own car with the higher mileage allowance according to the local travel agreement. If necessary, the cost of taxi will be reimbursed when the receipt has been handed in.

Note: The compensation/allowance is taxable.
